Donald Trump has waged war on the impeachment process, hoping that courts will ultimately back up his efforts to stonewall what is a constitutionally guaranteed power of Congress.
But as Laurence Tribe, professor of constitutional law at Harvard Law School, said on Saturday, Trump is going to lose badly if the impeachment fight reaches the United States Supreme Court.
During an interview with MSNBC’s Joy Reid, Tribe said, “The courts are beginning to hold that the president is violating the law.”
He added, “I think if any of these cases get to the Supreme Court, the president is going to lose. He’s going to lose even the votes of conservative jurists.”

The courts are beginning to hold that the president is violating the law, although it must be said that in the recent D.C. Circuit decision, one judge — the judge who was appointed by Donald Trump — had a rather remarkable descent in which she basically said that Congress has to stop investigating the president as soon as it comes upon impeachable offenses. … I think if any of these cases get to the Supreme Court, the president is going to lose. He’s going to lose even the votes of conservative jurists. But we don’t need to wait for the courts. The president has defied the constitution. He’s betrayed his oath. He’s betrayed more simply than our allies, the Kurds. He’s betrayed our efforts against ISIS. He’s betrayed the nation. And of all of those things, horrible as some of them are, the most obviously impeachable is his using his presidential power to shake down an ally against an adversary in order to create dirt against a political opponent. This is what the framers invented the impeachment power for, and it’s got to be used and it’s got to be used promptly.
For the past three years, Donald Trump has somewhat successfully treated the government like he’s treated women throughout his life – as a personal play-toy. With a Republican Party in Congress unwilling to stand up to him, he has largely gotten away with it.
But as Laurence Tribe noted on Saturday, Trump’s high crimes and misdemeanors are becoming so brazen that the courts are left with no choice but to hold that he’s violating the law.
If impeachment reaches the Supreme Court, Donald Trump will be in for a rude awakening when even the conservative justices will have no choice but to remind him that there is still a Constitution, even if he hasn’t read it.
