The state of California and the ACLU have each filed lawsuits against Trump for his national emergency border wall declaration.
The LA Times reported:
Gov. Gavin Newsom said Friday that California is planning to sue the Trump administration over its declaration of a national emergency on the southern border with Mexico, delivering on a promise state Atty. Gen. Xavier Becerra made last week “to reject this foolish proposal in court the moment it touches the ground.”
Newsom and Becerra announced they are developing plans for the legal action at a Capitol news conference just hours after President Trump declared a national emergency in an attempt to divert up to $6.6 billion from other projects, including military construction jobs, to build or reinforce as many as 234 miles of border barriers.
The ACLU also announced that they would be filing a lawsuit.
ACLU Executive Director Anthony Romero, “By the president’s very own admission in the Rose Garden, there is no national emergency. He just grew impatient and frustrated with Congress, and decided to move along his promise for a border wall ‘faster.’ This is a patently illegal power grab that hurts American communities and flouts the checks and balances that are hallmarks of our democracy. We will be filing a lawsuit early next week. As the country’s premier defender of civil liberties and civil rights, the ACLU will always fight to ensure a robust system of checks and balances on the power of the executive, which is critical to safeguarding our democracy and defending rights.”
Trump has doomed his own national emergency ploy
For a national emergency declaration to be upheld in court, there has to be an emergency. Trump has consistently made it clear that the only emergency that exists is that he wants a wall and Congress won’t give him the money.
Trump has pushed back the timeline on numerous occasions as he tried to cut a deal with Congress.
These lawsuits are just the beginning. House and Senate Democrats are going to sue Trump, and the administration is going to be overrun with lawsuits from all parties. If Republicans in the Senate were smart, they would kill this stupid idea and save their party, but Senate Majority Leader Mitch McConnell is a coward. He would rather let Trump lose in court than take a stand against this president.
