When an Attorney Helps a Client Commit a Crime Privilege Doesn’t Matter

President Trump woke up Tuesday morning after stewing in a rage over the FBI raiding his personal lawyer’s office and home Monday to scream “TOTAL WITCH HUNT!!!” and “Attorney-client privilege is dead!”

But the main exception to attorney client privilege is “crime fraud,” which is when an attorney helps a client commit a crime.

As Mueller tightens the noose, Trump is doing many of the things bad leaders and guilty people do. He is conflating himself with the country, saying an attack on him is an attack on the country. He is suggesting he should fire the Special Counsel. He is screaming witch hunt over a Republican Special Counsel and a Republican U.S. Attorney he appointed.

Odds are Trump will give in to his raging inability to operate remotely according to democratic principles and try to have Mueller fired. Republicans in Congress have warned him not to do this, but their words are effectively without teeth at this point, as they have enabled Trump’s biggest attack on America via the Russians and continue to do so.

Trump knows his own party have no spines and seemingly little patriotism to compel them to protect their country. It looks like a wide open escape hatch to someone like Trump, who can’t think past his own immediate needs.
