James Comey didn’t want to opine of whether or not Trump obstructed justice, but he made it clear that special counsel is investigating Trump for obstruction of justice.

While talking about Flynn, Comey said, “General Flynn was in legal jeopardy. There was an open FBI investigation into his statements in connection with the Russian contacts, so that was my assessment at the time. I don’t think it’s for me to say whether the conversation I had with the President was an effort to obstruct. I took it as a very concerning thing, very disturbing, but I’m sure that’s a conclusion that I’m sure the special counsel will work toward.”
In other words, Comey is a witness. It isn’t his place to accuse Donald Trump of crimes. However, it is the role of the special counsel to investigate whether or not Trump obstructed justice. and judging from Comey’s statements, the special prosecutor is investigating Trump for obstruction of justice.
